Mediation is an informal negotiation assisted by an impartial third party (i.e., the mediator) that encourages disputing parties to formulate the solutions for resolving their dispute. Mediation conferences may be utilized either as an alternative to arbitration or litigation, or as a mandatory step prior thereto. In mediation, the neutral mediator assists the parties in reaching a settlement, but does not have the authority to make a binding decision or award. Mediation is a highly useful tool to resolve a broad range of conflicts. The mediator facilitates communication and negotiation and promotes voluntary decision making by the parties to the dispute. Mediation serves various purposes, including providing the opportunity for parties to define and clarify issues, understand different perspectives, identify interests, explore and assess possible solutions, and reach mutually satisfactory agreements.
